The Coronavirus Act 2020 (Residential Tenancies: Protection from Eviction) (Amendment) (England) Regulations 2020

The Government released on Friday 28th August 2020, changes to the possession process for residential properties. These changes came into effect from 29th August 2020 and relate to an extension of notice period for section notices served from this date.

Section Notices now have a notice period of 6 months before a claim can be submitted to the courts. This is valid for all notices deemed served after 29th August 2020 and these changes do not affect notices served prior to this date.

According to Arla, there is a backlog of over 60,000 claims awaiting a hearing in the Courts and the Courts will be looking at ways to reduce these numbers and prioritise certain cases which may include rent arrears over 6 months and/or anti-social behaviour claims.
